Dispensasi Kawin Pasca Terbitnya Undang-Undang Nomor 16 Tahun 2019 tentang Perkawinan (Studi Kasus di Pengadilan Agama Jepara)

Abstract

This research is motivated by the author's curiosity about the high number of requests for dispensation from marriage, especially in the Jepara Religious Court. The high dispensation for marriage is related to the issuance of Law Number 16 of 2019 concerning Marriage. This study aims to find out the comparison of increases before and after the issuance of Law Number 16 of 2019 concerning Marriage, to find out what are the factors causing the application for marriage dispensation at the Jepara Religious Court after the issuance of Law Number 16 of 2019 concerning Marriage, and to find out the judge's considerations in granting the application for a marriage dispensation Number: 197/Pdt.P/2022/PA.Jepr at the Jepara Religious Court. The method used in this study is a qualitative method, then data collection techniques are obtained by obtaining the data through observation, interviews, and documentation. Researchers used triangulation as a technique to test the validity of the data which was then analyzed using descriptive qualitative. The final results of this study indicate that after the publication of Law Number 16 of 2019 at the Jepara Religious Court, applications for marriage dispensation cases have actually increased significantly, the increase from year to year the number of dispensation applications has increased in the Jepara Religious Court. The causative factors are promiscuity/pregnancy outside of marriage, social media, education, economy.
