Melakukan Izin Pernikahan bagi Prajurit TNI yang Akan Berkeluarga Perspektif Maslahah Mursalah

Abstract

Indonesia is a country that has a strong defense instrument. The instrument is the Indonesian National Army (TNI) which functions to carry out defense and maintain security both from within and outside the country. This study explores and examines more deeply the practice of obtaining marriage permits for TNI soldiers who are going to have families from the perspective of maslahah mursalah. This study uses library research with a qualitative approach that is descriptive in nature. The subjects of this study are books, articles, journals, notes, laws and regulations or other library materials related to marriage permits for TNI soldiers. In addition, researchers try to analyze data by focusing on information (data reduction) to obtain a complete picture (data display) and temporary conclusions can be drawn (verification). In addition, researchers use a juridical and normative approach. Therefore, the results of this study are reviewed from the perspective of maslahah mursalah including: a) Maslahah Hajjiyah: Marriage permit for TNI soldiers who are going to have a family to the Commander if not implemented, then it will not have an impact on the life system (main), b) Maslahah Al-'Ammah: Marriage permit for TNI soldiers who are going to have a family can create benefits for all TNI soldiers in carrying out their duties, c) Maslahah Mursalah: Marriage permit for TNI soldiers who are going to have a family does not yet have a text or ijma' that orders or does not allow it.
