Tinjauan Hukum Islam dan Hukum Positif Terhadap Tindakan Pengemisan dalam Upaya Membentuk Ketahanan Keluarga (Studi Kasus di Kabupaten Demak)

Abstract


The phenomenon of begging has not yet been completely resolved, there are still many beggars who carry out their activities by begging in Demak Regency, especially at tourist attractions such as the religious tourism of Sunan Kalijaga's grave and the great mosque of Demak. The author is interested in researching the phenomenon of begging as a source of family needs to support family resilience in Demak Regency. This research is field research (Field Research), namely direct research carried out by researchers in Demak Regency by going directly to locations such as the Sunan Kalijaga grave area and the Great Mosque of Demak using a qualitative approach. Data sources include primary data and secondary data. Primary data was obtained from interviews, observations and documentation with 10 (ten) beggars, Satpol PP and religious leaders. Meanwhile, secondary data was obtained from library data. Data analysis techniques are carried out using data reduction, data presentation and drawing conclusions. The results of this research show that what makes someone engage in begging is an effort to build family resilience, namely to meet the family's needs. In Islam, based on the Koran, Surah al-Baqarah verse 273 and the hadith of the History of At-Tirmidhi, someone who begs is haram. Demak Regency Regional Regulation Number 2 of 2015 concerning Management of Community Diseases explains that begging is a prohibited activity and if this is done, sanctions will be imposed on the perpetrator or someone who provides and provides facilities and infrastructure for begging activities.
