Tinjauan Fikih Muamalah terhadap Praktik Penjualan Kacang Hijau Hasil dari Ngasak (Studi Kasus di Desa Sambung Kecamatan Godong Kabupaten Grobogan)

Abstract


This research explores the practice of selling green beans produced from ngasak in Sambung Village, Godong District, Grobogan Regency, seen from the perspective of a review of muamalah fiqh. In this research, the subjects studied include people who own rice fields, those who practice ngasak, and village officials. This research uses field research using a qualitative approach. The results of this research are that the ngasak tradition is classified as 'urf sahih and may be carried out or preserved in the Sambung Village environment because there are rules of علم رظاة which relate to a person's willingness to use someone else's property without permission and believe that the owner will definitely agree and it is appropriate and does not conflict with Islamic law. The practice of selling green beans from ngasak is legal because the payment is made at the time the sale and purchase takes place between the seller and the buyer and is in the same place. So this sale and purchase is legal because the owner has agreed and it has become the right of the picker. In the practice of selling green beans, the results of the ngasak that occurred in Sambung Village, Kec. Godong, Kab. Grobogan that the conditions for buying and selling that have been determined are fulfilled.
