Penyelesaian Sengketa Batas Tanah Melalui Mediasi (Studi Kasus di Desa Maguan Kecamatan Kaliori Kabupaten Rembang)

Abstract


In essence, the problem starts with the first party who will build a fence close to the border of the second party's land. When measuring the length of the fence to be built, the second party did not accept it until there was a land boundary problem in Maguan Village. then the problem was resolved through mediation by the National Land Agency of Rembang Regency. This study aims to determine the mechanisms for resolving land boundary disputes through mediation in Maguan Village and to determine the factors supporting the success of dispute resolution through mediation. The type of research that the author uses is field research using qualitative descriptive research methods and juridical-normative research approaches, where this research uses legal sources such as laws and regulations and documents related to research problems. The results of the study show that the mechanism for resolving land boundary disputes in Maguan Village by the National Land Agency of Rembang Regency is in accordance with the laws and regulations in force in Indonesia. Settlement of land boundary disputes in Maguan Village was carried out through mediation by the Rembang Regency National Land Agency who acted as a mediator. Mediation was carried out until a common ground was found and was declared successful. This success was supported by several factors including the good faith of both parties, supportive input from the mediator, the parties willing to listen to input from the mediator, and the neutral attitude of the mediator.
