Implementasi Mediasi dalam Penyelesaian Sengketa Jual Beli Tanah (Studi Putusan Pengadilan Negeri Rembang No.11/pdt.G/2022/PN.Rbg)

Abstract

Buying and selling of land has been going on for a long time, therefore the problem of land has been going on for a long time. Land disputes can occur because of an agreement or terms of sale that have not been fulfilled between the buyer and the seller. In the sale and purchase of land disputes are resolved by mediation, the end result is peace. This study aims to determine the mediation process at the Rembang District Court and the factors that influence the successful mediation of land sale and purchase disputes at the Rembang District Court decision No.11/pdt.G/2022/PN.Rbg. This research uses Fieid Research method (Field research). This research is referred to as field research because researchers conduct direct studies in the field, to obtain factual data about the processes and factors that influence the success of mediation in land sale and purchase disputes at the Rembang District Court Decision No.11/pdt.G/2022/PN.Rbg , as well as the data used in this study. This research use desciptive qualitative approach. The results of the research and analysis show that the mediation process for land sale and purchase disputes at the Rembang District Court is in accordance with Supreme Court Regulation Number 1 of 2016 and the factors that influence the successful mediation of land sale and purchase disputes at the Rembang District Court Decision No.11/pdt.G/ 2022/PN.Rbg is due to the skill of the mediator in carrying out his duties and the parties agree to the agreement made with the mediator.
