Pemahaman Penyelesaian Sengketa Tanah Melalui Mekanisme Non Litigasi Dan Litigasi Kepada Masyarakat Di Kelurahan Penggaron Lor Kota Semarang

Abstract

Carrying out the Tri Dharma of Higher Education is an obligation carried out by Lecturers. Penggaron Lor Village, Genuk District, Semarang City is a partner of the Faculty of Law, Semarang University, so that the service carried out is certainly measurable and directed according to the needs of the community, especially in Penggaron Lor Village, Genuk District, Semarang City. When conducting a stakeholder survey in the area, it was proposed that there be a Community Service activity with the theme Understanding Land Dispute Resolution Through Non-Litigation and Litigation Mechanisms. This understanding is needed in dealing with everyday life both in maintaining relationships with the local community and with family. One of the most common land problems is of course with the residential environment and family later if there is an inheritance relationship. Understanding the resolution of this land dispute is very necessary because it can consider the mechanism that will be taken in resolving land disputes either by litigation or non-litigation. Maintaining good relations with the environment and with family is very important considering that Indonesian society has an eastern culture so that the emphasis on resolving land disputes with non-litigation mechanisms is prioritized. The purpose of this community service is to provide an overview of efforts to resolve land disputes using litigation and non-litigation mechanisms, of course, so that the community can get an overview of its advantages and disadvantages. In addition, several representatives from the community in Penggaron Lor Village, Genuk District, Semarang City, are expected to become further counselors regarding the importance of knowing the litigation and non-litigation paths in resolving land disputes. The method used in this study is a type of normative research that is prescriptive using a statutory, historical, and conceptual approach and the implementation is carried out by written pre-tests, counseling, and questions and answers. Based on the results of community service and discussion, it was concluded that many people in Penggaron Lor Village, Genuk District, Semarang City do not understand the resolution of land disputes either by litigation or non-litigation mechanisms, so in order to anticipate this, of course, this understanding is very necessary and on average in resolving land disputes in the questionnaire that has been distributed, many agree that land disputes are resolved through mediation or conciliation mechanisms.
